Prosecutors Tuesday morning told Judge Wolfson the Miami State Attorney’s Office is reviewing whether to waive the death penalty for Liberty City gangster Corey Smith of the John Does.

The judge gave the prosecutor and Corey Smith’s defense attorney until the first week in February to come up with a plea deal.
